The judges generally believe the presence of attorneys in the courtroom allows for quicker and more efficient solutions. In most instances, telephone appearances should only occur when the attorney wants to listen and not participate.
The judges will consider requests to appear by telephone on a case-by-case basis.
Relevant factors considered might include:
- The expedited nature of the hearing.
- Conduct of attorneys at prior telephonic hearings.
- Weather and other outside factors.
- Frequency of requests to appear by telephone.
- Cost resulting from unusual or extraordinary circumstances.
